Idaho Digital Accessibility Law
Idaho has no state-specific digital accessibility statute and no private right of action or statutory damages for inaccessible government software or websites. State requirements are set administratively by the Idaho Office of Information Technology Services (ITS) and Idaho Technology Authority (web-publishing policy P5010 and related accessibility standards) for state agencies, layered on the binding federal ADA Title II Web and Mobile Accessibility rule (28 CFR Part 35), which adopts WCAG 2.1 Level AA. Enforcement is therefore federal and complaint/DOJ-driven (with the usual undue-burden and fundamental-alteration defenses), on the federal timeline of April 26, 2026 (population 50,000+) and April 26, 2027 (smaller entities). Idaho's general Consumer Protection Act damages do not apply to public-entity accessibility procurement.
What the law requires
- Responsible agency Idaho Office of Information Technology Services (ITS); standards set by the Idaho Technology Authority (ITA) (its.idaho.gov/digital-accessibility-resources/accessibility-requirements/) (opens in new tab)
- Adopted standard WCAG 2.1 Level AA, consistent with the federal ADA Title II rule; Idaho web-publishing policy also references ADA and Section 508 alignment.
- Who it covers Idaho state executive-branch agencies and public-facing web content/ICT developed by or for state agencies, plus third parties/vendors performing services on the state's behalf. The federal ADA Title II rule independently covers all state and local government entities, including public higher education and local governments.
- Private right of action No state accessibility-specific private right of action. Enforcement of the federal ADA Title II baseline is via DOJ and private ADA suits in federal court. Idaho's general Consumer Protection Act (Idaho Code 48-608) provides a private right of action only for consumer purchase/lease transactions involving deceptive trade practices and does not apply to public-entity digital accessibility procurement.
- Statutory damages / penalties None for digital accessibility. There is no Idaho statute imposing per-violation accessibility fines or statutory damages. (Idaho Code 48-608 provides $1,000 or actual damages, and a $15,000 / treble-damages enhancement for elderly or disabled consumers, but only for consumer transactions with ascertainable loss, not for government website/ICT accessibility.) ADA Title II carries no private statutory-damage award; remedies are injunctive plus DOJ civil penalties under the federal scheme.
- Exemptions Under the governing federal ADA Title II rule: undue financial/administrative burden and fundamental alteration defenses apply, plus rule-specific exceptions (archived web content, preexisting conventional electronic documents, third-party content, individualized password-protected documents, and certain social media posts). No additional Idaho-specific statutory exemptions identified.
- Governing authority No accessibility-specific Idaho statute. Requirements arise from ITS / Idaho Technology Authority administrative policy (ITA Policy P5010 Web Publishing; related Standard S5120 / Guideline G310 and ITS digital accessibility requirements), issued under the ITS coordination authority in Idaho Code Title 67, Chapter 8 (e.g., Idaho Code 67-827). The binding legal baseline is the federal ADA Title II Web and Mobile Accessibility Final Rule (28 CFR Part 35).
- Compliance deadline Federal Title II dates apply: WCAG 2.1 AA by April 26, 2026 for public entities with population 50,000+, and April 26, 2027 for smaller entities and special district governments. Idaho ITS notes the April 26, 2027 state deadline and that agencies must begin including accessibility requirements in ICT contracts around April 2026. No separate Idaho statutory deadline.
